Terms and Conditions (T&Cs)

1. Scope of Application

These General Terms and Conditions (T&Cs) apply to all orders placed through the Faluun online shop.

By submitting an order, the customer agrees to these T&Cs.

Faluun reserves the right to change these T&Cs at any time. The version valid at the time of the order is decisive.

2. Offer and Conclusion of Contract

The presentation of products in the online shop constitutes an offer to purchase.

By submitting the order, the customer makes a binding offer to conclude a purchase contract.

The purchase contract is concluded as soon as Faluun confirms the order by e-mail or processes the order.

Faluun reserves the right to refuse or cancel orders, particularly in cases of obvious pricing errors, unavailable products, or technical problems. Any payments already made will be fully refunded in such cases.

3. Prices

All prices stated in the online shop are in Swiss Francs (CHF) and, unless otherwise stated, include the legally required value-added tax.

Additional shipping costs will be shown separately in the ordering process.

The price stated at the time of the order is decisive.

4. Order and Payment

The available payment methods will be displayed during the ordering process.

Payment is generally due immediately after the order is placed.

In case of unsuccessful payment, Faluun may cancel the order.

5. Delivery

Faluun delivers within the delivery areas specified in the online shop.

The estimated delivery time is indicated for each product or during the ordering process.

Should a product unexpectedly be unavailable, the customer will be informed. Amounts already paid for undeliverable products will be refunded.

For international deliveries, additional customs duties, import taxes, or other charges may apply. Unless otherwise stated, these are borne by the customer.

6. Retention of Title

The ordered goods remain the property of Faluun until full payment has been received.

7. Returns

Faluun voluntarily grants a right of return of 14 days from receipt of the order.

The return must be announced by e-mail to [E-mail address] within this period.

The goods must be unworn, unwashed, and in a resalable condition. Original tags, if present, must be attached.

Excluded from return are, in particular, goods that have been worn, washed, damaged, or individually altered.

The costs of return shipping are generally borne by the customer.

After receipt and inspection of the returned goods, the corresponding purchase price will be refunded via the originally used payment method.

The refund will be made minus any shipping costs, unless these are expressly covered by Faluun.

8. Exchange

A direct exchange is generally not provided.

Anyone who wants a different size or product can return the original order within the scope of the right of return and then place a new order.

9. Defects and Warranty

Faluun warrants that the products sold are free from defects upon delivery.

The customer is obliged to inspect the goods for obvious defects as soon as possible after receipt and to contact Faluun as quickly as possible if a defect is found.

In the case of justified defects, the statutory warranty rights apply.

Faluun can, if possible, offer a replacement delivery or another appropriate solution for a justified defect.

The statutory rights of the customer remain reserved.

10. Liability

Faluun is liable for damages caused by intentional or grossly negligent conduct.

To the extent permitted by law, liability for indirect damages and consequential damages is excluded.

Faluun assumes no liability for damages resulting from improper use, normal wear and tear, or external influences on the products.

Mandatory statutory liability provisions remain reserved.

11. Data Protection

Faluun processes personal data in accordance with the data protection declaration published on the website.

The data protection declaration is part of Faluun's information offering but does not constitute a part of these T&Cs.

12. Intellectual Property

All content of the online shop, including texts, photographs, graphics, logos, designs, and product presentations, is the property of Faluun or appropriately licensed.

Use, reproduction, or redistribution without prior consent is not permitted.

13. Applicable Law

Swiss law is applicable to all contractual relationships between Faluun and the customer.

Mandatory statutory provisions of the country in which the customer has their habitual residence remain reserved, provided these are mandatorily applicable.

14. Place of Jurisdiction

For disputes, the statutory place of jurisdiction applies, to the extent permitted by law.

For consumers, the mandatory statutory provisions regarding jurisdiction apply.

15. Severability Clause

Should any provision of these T&Cs be wholly or partially ineffective or unenforceable, the effectiveness of the remaining provisions shall remain unaffected.

Instead of the ineffective provision, the relevant statutory provisions shall apply.
